Treating EWS as a separate category is reasonable classification and the 50 per cent ceiling on the total reservation under the Mandal judgment is "not inflexible", the judges said while dismissing petitions challenging the 103rd Constitution Amendment of 2019. The bench headed by Chief Justice U U Lalit delivered four judgements on 40 petitions against the Amendment that was passed after the Centre decided to grant quota to the economically weaker sections. Relief for J’khand CM, SC sets aside HC order in a mining lease case NEW DELHI: Relief for Jharkhand Chief Minister Hemant Soren, as the Supreme Court on Monday set aside the Jharkhand High Court, which had upheld the maintainability of a PILs seeking probe against Soren in a mining lease case. On August 17, the Supreme Court had stayed the proceedings before the Jharkhand High Court on PILs filed against Chief Minister Hemant Soren alleging money laundering shell companies and irregularities while granting mining leases, and also reserved its verdict on pleas filed by the state government and Soren challenging maintainability of PILs before high court. Today, Justice Dhulia allowed the appeals filed by the state government and Soren against the high court order. BENCHSAID LEADERSPEAK The Supreme Court’s decision is a slap on the face of parties with vested interests who have tried to sow discord amongst citizens with their propaganda. JUSTICE MAHESHWARI: Basic structure can’t be breached by enabling state to make provisions for education. Reservations for EWS does not violate basic structure on account of 50% ceiling limit because ceiling limit is not inflexible. JUSTICE BELA M TRIVEDI: “Socially and Educationally Backward Classes form separate categories. They can’t be treated at par with unreserved category. Benefit under EWS can’t be said to be discriminatory.” JUSTICE S RAVINDRA BHAT: “Reservation is contrary to the essence of equal opportunity. The 103rd amendment practices prohibited forms of discrimination.” JUSTICE S RAVINDRA BHAT: “Reservations were designed as powerful tool to enable equal access. Introduction of economic criteria and excluding SC, ST, OBC, saying they had these pre-existing benefits is injustice.” JUSTICE S RAVINDRA BHAT: “By excluding the poor among SC/ST/OBC from economically backward classes, the amendment practices constitutionally prohibited forms of discrimination.” JUSTICE PARDIWALA: “Reservation is not an end, it is a means. It should not be allowed to become a vested interest.” Justices Dinesh Maheshwari, Bela M Trivedi and J B Pardiwala upheld the EWS quota. The CJI, on his last day of presiding court proceedings, was in minority with Justice S Ravindra Bhat when they ruled against it, holding that due to exclusion of poor of SCs, STs, and OBSs from its ambit the Amendment practices "constitutionally prohibited forms of discrimination". They killed a spotted dear on Monday morning. Principal Chief Conservator of Forest (PCCF) Jasbeer Singh told Free Press that two cheetahs killed a spotted dear in their big enclosure in Kuno National Park. He said preparations were underway to release remaining cheetahs into big enclosures. Cheetahs will live in their big enclosures for two to three months. Later, Cheetah Task Force and others associated with the Cheetah Project will take the final decision to release them into the wild. When contacted, Divisional Forest Officer of Kuno National Park, Prakash Kumar Verma said when patrolling staff went to the big enclosure of recently released two cheetahs, they found that both cheetahs had killed a spotted dear. “They have demonstrated killing instinct, which is a good sign,” he added. He also said the work of remaining big enclosures was nearing completion in which remaining cheetahs will be released in near future. The Cheetah Task Force has issued certain direc- UK court approves extradition of accused middleman Sanjay Bhandari LONDON: A UK court on Monday ruled that Sanjay Bhandari, an accused middleman and consultant in arms deals, can be extradited to India to face charges of tax evasion and money laundering. The 60-yearold faced two extradition requests from the Indian authorities, the first related to money laundering and the second to tax evasion. District Judge Michael Snow, who heard the case at Westminster Magistrates' Court in London earlier this year, concluded that there are no bars to him being extradited and decided to send the case to UK Home Secretary Suella Braverman, who is authorised to order the extradition based on the court order. "As I am satisfied that extradition is compatible with the defendant's Convention rights, I must send this case to the Secretary of State [Braverman] for a decision as to whether the defendant is to be extradited," Judge Snow said in his judgment. Speaking at the UN Secretary General High Level Round Table to launch the "Early Warnings for All Executive Action Plan", Yadav stressed that the global pace of climate mitigation is not enough to contain the rate of climate change. There is an urgent need to acknowledge the cascading natural hazards that cause substantial losses around the world, he said, adding that India fully supports the UN secretary general's agenda to achieve "Early Warnings for All". With the intensification of tropical cyclones in the Pacific and the Caribbean, small tropical States have lost 200 per cent of their national income in a few hours. Such instances could have devastating consequences in countries that do not have sufficient means to cope with them, Yadav said. "With climate finance still scarce, climate adaptation in the form of early warning dissemination is key in safeguarding lives and livelihoods.
