Since it has been confirmed that it's his voice I order suspension of Jhabua SP who was transferred in the morning." Noting conflicting rulings on hearing an accused before imposing the death sentence, the Bench, also comprising Justices SR Bhat and Sudhanshu Dhulia, said: “It is necessary to have clarity in the matter on a uniform approach on the question of granting real and meaningful opportunity of hearing to the accused in such cases. Reference to a large bench of five hon’ble judge is necessary. Let the matter be place before the hon’ble CJI.” Seeing an urgent need to ensure that mitigating circumstances for conviction in capital offences are considered at the trial stage, the top court had taken note of the issue on its own. The bench wants the court to develop guidelines to be followed by courts across the country while deciding such cases. It had sought assistance from Attorney General K K Venugopal and also issued notice to the National Legal Services Authority (NALSA). CONTD.
