HC to IMC: Conduct survey to identify illegal constructions In his petition, Sisodiya had stated that large number of illegal constructions have take place in the city but no action is being initiated by IMC Atul GAutAm Indore Indore bench of Madhya Pradesh High Court has directed Indore Municipal Corporation commissioner to conduct a survey for identifying unauthorised constructions within the municipal limits and initiate action against irregularities. While disposing of a petition filed against illegal constructions in some multistorey buildings in the city , division bench Justice SC Sharma and Justice Virendra Singh stated that the IMC commissioner should conduct a survey and ensure that action is initiated against all unauthorised constructions in accordance with law. Earlier, the IMC assured the court of all possible steps to remove the illegal constructions in keeping in view the provisions of the MP Municipal Corporation Act, 1956. The petitioner and former corporator Pramanand Sisodiya had said that the order on was pronounced on November 24, 2018 but its certified copy was issued on January 2. A top government functionary said a constitutional amendment bill will be tabled in Parliament Tuesday, the last day of the Winter Session. The proposed reservation will be over and above the existing 50%reservation enjoyed by the SC, ST and OBC,taking the total reservation to 60 per cent. The amendment bill would be required as the Constitution does not provide for reservation on the ground of economic conditions. It envisages amendment to Articles 15 and 16 of the Constitution. A minister said the bill once passed will amend the Constitution to give reservation to the poor among general castes. "The bill will provide a shelter for upper castes under the rubric of fundamental rights. The court's rule of the maximum 50% quota cannot fetter Parliament's right to amend the Constitution," he said. In its famous Indra Sawhney judgement, the SC had set a cap of 50% cap on quotas.
