A five-judge Constitution bench, headed by Justice KM Joseph, said, “Suppose there is some allegation against the Prime Minister and the CEC has to act. But the CEC is weak-kneed. He does not act. Is it not a complete breakdown of the system?” The CEC is supposed to be insulated from political influence and be independent, the bench said. “These are aspects you must delve into... why we require an independent larger body for selection and not just the Cabinet.” Several committees have said there is a dire need for change and politicians also shout from the rooftops, but nothing happens, the bench noted. The bench, which includes Justices Ajay RastoBose, Aniruddha gi, Hrishikesh Roy and CT Ravikumar, said its endeavour is to put in place a system so that the “best man” is selected as the CEC. “There have been numerous CECs and TN Seshan happens once in a while. We do not want anyone to bulldoze him. Enormous power has been vested on the fragile shoulders of three men [two E.C.s and the CEC].” CJI's inclusion will ensure independence in appointment of CEC, says Apex court &30 %@;=080 :@=? :9 )0/90>/,D >,4/ ?: 09>@=0 49/0;09/09.0 :1 ?30 ;:77 ;,907 ?30 3401 @>?4.0 :1 .:@7/ -0 49.7@/0/ 49 ?30 .:9>@7?,?4A0 ;=:.0>> 1:= 9/4, ?30 ,;;:49?809? :1 Moily, Quraishi support SC observation 0B 0734 :=80= '94:9 7,B 8494>?0= (00=,;;, :47D %+ #@=,4>34 >@;;:=?0/ , .:9>@7?,?4A0 80.3,94>8 ,9/ 0C > B3470 ,9:?30= 1:=80= 30,/ :1 ,9/ ?: ,;;:49? ?30 ?30 ;:77 ;,907 ;@>30/ 1:= , -:/D ?: ,;;:49? 5@/20> 49 ?30 % ,9/ ?30 3423 .:@=?> SEEKS EC GOEL’S FILE &30 %@;=080 :@=? ,7>: ,>60/ ?30 09?=0 ?: ;=:/@.0 ?30 1470 =07,?0/ ?: 70.?4:9 :884>>4:90= =@9 :07 B3: B,> &30 ,;;:49?0/ :9 :A 14A0 5@/20 :9>?4?@?4:9 -09.3 30,/0/ -D @>?4.0 :>0;3 B,9?0/ ?: 69:B ?30 ;=:.0/@=0 1:= = :07H> ,;;:49?809? ,> 30 3,/ :97D =0.09?7D ?,609 A:7@9?,=D =0?4=0809? ??:=90D 090=,7 $ (096,?,=,8,94 ?:7/ ?30 -09.3 ?3,? 4?
