The Bench of Justices Ashok Bhushan, R Subhash Reddy and M R Shah had reserved the ruling on August 18 after completing days of hearing. A number of students, parents and state governments have pleaded that the government should cancel the exams in view of the Covid-19 pandemic and allow the universities to issue degrees on the basis of the performance, either during first and second year of exams or the results of the past semesters. The Centre and the UGC have, however, taken the stand that the state governments on their own cannot cancel the exams. HIGHEST ‘C’ CASES India on Thursday recorded the highest ever Covid-19 infections in 75,761 persons, pushing the country's coronavirus tally to over 33.1 lakh cases. India has the thirdhighest coronavirus caseload in the world after the United States (60 lakh) and Brazil (37.22 lakh). The good news, however, is that 25,23,771 patients have recovered from infection in the country, taking the recovery rate to 76.24 per cent. Maharashtra remains the hardest-hit state, accounting for 7,18,711 cases. It is followed by three southern states -Tamil Nadu, Andhra Pradesh and Karnataka. SC BID TO AVOID MEDIA ROLE CASE The Supreme Court on Thursday tried to wriggle out of a petition filed by Jamiat Ulama-i-Hind seeking action against TV media for communalising the Nizamuddin Tablighi Jamaat congregation held in March, asking it to approach the News Broadcasting Standards Authority for the preliminary determination of the issue before the court hears it. Apparently, the court did not want to act in a manner that is perceived as putting curbs on press freedom; so, it wanted the NBSA headed by one of the Apex Court's former judges to handle the matter. A 3judge Bench headed by Chief Justice Sharad Arvind Bobde even threatened to dismiss the petition if the organisation was not willing to go to the NBSA but finally conceded to the demand of its senior counsel Dushyant Dave's to hear the matter on September 23. To most people, COVID-19 peak seems to have passed in Madhya Pradesh as the recovery rate has risen to 76 per cent and the fatality rate has come down to 2.25 per cent. However, medical experts say that positive cases and recovery rate are not stable. Therefore, there is no assurance that peak has passed or yet to arrive the state. The number of corona positive cases reported everyday fluctuates. On one particular day it is 100 , while the next day it rises to 200. On third day, it can be less than 100. The recovery rate of Bhopal is 81 per cent, Indore is 69 per cent, Gwalior is 75 per cent and Morena is 94 per cent. According to health department, if recovery rate is 75 per cent or over it, it shows that peak has passed. As for Bhopal, it is 81 per cent so peak has already passed but in Indore it is yet to come. Pulmonologist at Gandhi DEWAS MP TESTS POSITIVE BHOPAL: dewas lok sabha member mahendra singh solanki has been tested covid-19 positive on thursday. collector chandra mauli shukla confirmed it stating that the mP has left for bhopal and would be admitted to chirayu hospital. solanki too tweeted about his report and asked all people who came in his contact to get tested for the infection. Medical College Dr Lokendra Dave said Madhya Pradesh’s peak of Covid-19 infection is a major issue. “Has it already happened? Or are we close to it? We cannot make specific comment about peak whether it has gone or it will come as corona positive cases are still surfacing from different pockets,” he said. In Bhopal district, Jahangirabad, Budhwara, Aishabag, Jatkhedi were hotspots initially. Now corona positive cases are coming from Arera Colony, Shivaji Nagar, Char Imli. The state government has made arrangements to provide• free corona treatment in government and contractual private hospitals in the state. But the number of infected cases has not stabilised. The number of COVID-19 cases in the state reached 56,864 after 1,064 new cases were reported in past 24 hours. A 5-judge Constitution Bench of the Supreme Court, headed by Justice Arun Mishra, on Thursday answered in affirmative and upheld Punjab's 2016 law as constitutional. This legislation gave "first preference" to members of the 'Balmiki' Samaj and 'Mazbhi Sikh' communities for securing SC quota in public services. "Once the State has the power to give reservations, it can also make sub classifications, which allows them to facilitate reservation for backward classes," ruled the Bench which also comprised Justices Indira Banerjee, Vineet Saran, MR Shah and Krishna Murari. The case was initially dealt by a 3-judge Bench of SC SAYS NO TO TAZIAS Our Bureau NEW DELHI The SC on Thursday refused permission to the Shia Muslims to take out Tazia processions on Saturday and Sunday on the occasion of Muharram, pointing out that the community will again be accused of spreading coronavirus, as were those who participated in a Tablighi Jamaat congregation at Nizamuddin. A Bench headed by Chief Justice Sharad Arvind Bobde rejected the plea by Shia cleric Syed Kalbe Jawad of UP, noting that the processions at the time of the Covid-19 pandemic will create anarchy and the community will be unnecessarily blamed for it, if permission is granted. The petition had cited the permission given to the Jagannath Rath Yatra in Puri. The CJI said the ‘yatra’ was restricted to one city and had a fixed route; the court had permitted the event after evaluating the risks, while the petitioner is seeking permission for Tazia processions all over the country . The Bench told Jawad that the court cannot put health of the people at risk.
