In a statement on Friday, the National Human Rights Commission (NHRC) said the complainants have also sought its “intervention for an appropriate enquiry into the incident of stone-pelting and assault by an unruly and disruptive mob on Army personnel in Shopian district of Jammu and Kashmir on January 27”. In their complaint, the children have said they were ‘disturbed’ by the recent incidents of stonepelting and assaults by mobs on security forces, according to the statement. The commission has observed that in view of the facts narrated and allegations levelled in the complaint, “it will be appropriate to call for a factual report from the Ministry of Defence, through its secretary, to know the present status of the situation and steps taken by the Union government on the points raised by the complainants regarding alleged humiliation and violation of the human rights of the Army personnel in the state of J&K”. A communication has been sent to the defence secretary, seeking a report in four weeks, it said. The Finance Act and the Tribunal, Appellate and other Authorities (Qualifications, Experience and other conditions of Service of Members) Rules, which govern appointments, tenure, removal and other service conditions of chairpersons and members of tribunals, had been challenged on grounds including that they gave more powers to the executive and interfered with the judicial independence of the panels. In an order, which virtually stayed the new law and the rules on tribunals, a bench headed by Chief Justice Dipak Misra said the appointments in tribunals like Central Administrative Tribunal (CAT), National Green Tribunal (NGT) and Armed Forces Tribunal (AFT) would be made under the old rules with some modifications. Attorney General K K Venugopal, appearing for the Centre, consented to the suggestions mooted to make functional an interim arrangement to fill up posts of chairpersons, judicial, administrative and technical or expert members on all panels. The top court also requested the chief justices of all high courts to register proceedings on their own for effective implementation of the Juvenile Justice (Care and Protection of Children) Act, 2015. The Group Captain had been detained by the IAF for investigation on January 31 after his activities were found ‘suspicious’. The Air Force had approached the Delhi Police to investigate the case. According to a Special Cell officer, privy to the investigation, Marwaha, 51, shared information and documents with two Pakistani agents who chatted with him on social media site Facebook, pretending to be women.
